1. Introduction

Welcome to Zarpar.com.co ("we", "our", or "Zarpar"). These Terms and Conditions govern your use of our platform for booking maritime experiences, accommodations, and related services in Colombia.

By accessing or using our platform, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use our services.

2. Services Provided

Zarpar operates as an online marketplace connecting service providers (hotels, boat operators, tour operators) with customers seeking maritime experiences and accommodations.

  • Day passes to beach clubs and resorts
  • Overnight stays at coastal accommodations
  • Boat rentals and maritime tours
  • Island excursions and experiences
  • Combo packages and special events

3. Booking and Reservations

3.1 Booking Process

To make a reservation, you must provide accurate and complete information including: full name, email address, phone number, and payment details.

3.2 Confirmation

A booking is confirmed once payment is processed and you receive a confirmation email. Please retain this email as proof of your reservation.

3.3 Payment

We accept payments through Mercado Pago and Wompi. Payment options may include:

  • 100% upfront payment
  • 50% deposit (where applicable)

3.4 Discount Coupons

Zarpar may issue discount coupons or promotional codes for payments made through our payment gateways. The following rules apply to all coupons, in addition to any specific conditions communicated with each campaign:

  • Coupons are personal and non-transferable, and cannot be exchanged for cash.
  • Unless otherwise stated, each coupon may be redeemed only once per customer (identified by email address and/or identification number). Some coupons may allow one redemption per customer per vessel.
  • Coupons have a validity period and/or a maximum number of total redemptions; once reached, the coupon is no longer valid.
  • Coupons are not cumulative with other coupons or promotions. A coupon may be combined with the bank transfer discount only as configured for the active campaign: by default the customer receives the greater of the two discounts, unless Zarpar enables adding both.
  • Coupons may require a minimum booking amount and may be limited to specific vessels.
  • Each coupon is valid only for the experience it was issued for (full-day boat tour, sunset tour, etc.). Since prices differ significantly, a coupon for full-day tours does not apply to sunset tours and vice versa.
  • If a booking with a redeemed coupon is cancelled, the redemption may be released at Zarpar's discretion.
  • Zarpar reserves the right to cancel bookings and/or invalidate coupons in case of fraud, misuse, or attempts to circumvent these rules (e.g., using multiple identities), and to modify or terminate any coupon campaign at any time.
  • Refunds for bookings paid with a coupon are calculated on the amount actually paid, not on the price before the discount.

3.5 Bank Transfer Payment (Offline)

We may offer the option to pay by bank transfer with an automatic discount. The following conditions apply:

  • When choosing bank transfer, the customer has a limited time window (displayed on screen at checkout) to complete the transfer. If the time expires, the booking request is automatically cancelled, the date is released, and the customer must submit a new booking request.
  • The booking is confirmed only after Zarpar's administration verifies the transfer and approves the payment. Confirmation notifications and the electronic invoice are issued upon approval.
  • The bank transfer discount may be combined with a discount coupon according to the active campaign: by default the customer receives the greater of the two, and Zarpar may enable adding both. It is not cumulative with other promotions.
  • Only one active bank transfer request is allowed per customer at a time.
  • Zarpar reserves the right to reject or cancel transfer payment requests in case of suspected fraud or misuse of the discount.

3.6 Drinks, Snacks and Other Complimentary Items On Board

Some boats offer drinks, ice, snacks, fruit or other treats on board. These items are complimentary: they are not part of the agreed price, they are not charged or invoiced separately, and their value is not included in the fare you pay. Accordingly:

  • Complimentary items are not mandatory and may vary, be reduced, be replaced with products of similar characteristics, or not be provided at all, without changing the booking price or giving rise to any refund, discount or compensation.
  • Brand, presentation, flavour and quantity depend on distributor availability on the day of departure and on dock supply logistics. A change of brand or an incomplete delivery of complimentary items does not constitute a breach of the contracted service.
  • Maritime transport has weight, space and cold-chain limits. The captain may adjust or omit complimentary items for reasons of safety, capacity or food preservation.
  • Complimentary items are for consumption during the trip; they are not transferable, redeemable for cash, or carried over to another departure.
  • By completing payment you acknowledge and accept this condition, together with the other conditions and restrictions in these Terms and in the On-Board Rules.

What we do guarantee. This clause applies to complimentary items only. Whatever is published on the boat listing under «What’s included», as well as any add-on you have paid for (chef, bar, decoration, extra hours or others), is part of the contracted service and is enforceable. If any of those elements is not provided, Zarpar will replace it with an equivalent or refund the proportional amount paid for it.

If something included is not delivered during your trip, please report it the same day via WhatsApp or our contact email so we can verify it with the operator and resolve it.

3.7 Vessel Substitution and Continuity of Service

What you book is the nautical experience (the tour, the route and the services described in your booking), not one specific hull. Boating is subject to mechanical failures, unforeseen maintenance, decisions by the maritime authority and sea conditions. Therefore:

  • Zarpar and its operators may substitute the assigned vessel with another of equal or higher category and capacity, before departure or during the service, for operational, mechanical or safety reasons, or when instructed by the authority.
  • The substitution is communicated to you and accepted by you before boarding. Once the service is provided with the replacement vessel, the contract is deemed fulfilled and the substitution alone does not give rise to any refund, discount or compensation.
  • If you do not accept the replacement vessel, you may reschedule your departure at no cost, subject to availability, or request a refund of the portion of the service that was not provided.
  • If the replacement is of lower capacity or category and you choose to accept it, the corresponding proportional difference is refunded to you.
  • Delays. Where departure is delayed for these reasons, the time is made up by extending the return time whenever operations and the maritime authority allow. Where that is not possible, the service time not provided is refunded proportionally. A delay that does not prevent the booked tour from taking place does not give rise to a refund of the full amount.
  • By making payment you declare that you know and accept this condition.

What we DO guarantee. We guarantee the tour you booked: its duration, route, passenger capacity and everything published under «What's included». If the service is not provided at all, or is provided in a way substantially different from what was booked, you are entitled to reschedule at no cost or to a refund of the amount paid for the portion not provided, in accordance with Section 4 of these Terms.

If any of this happens during your trip, report it the same day via WhatsApp or to our contact email: that is when we can verify it with the operator and provide you with a solution.

3.8 Services Operated by Third Parties and Split Payment (diving, snorkelling and similar experiences)

Some experiences published on Zarpar — diving, snorkelling and other nautical activities — are operated by an independent third-party operator, whose name is disclosed to you before you pay. Zarpar sells and collects the reservation, issues the corresponding electronic invoice and coordinates the booking with that operator.

  • Availability is by capacity and must be confirmed. Submitting the form is a request, not a booking: it does not reserve your place and you are not charged. Your place exists only once the operator confirms availability and you pay the reservation within the period stated in the confirmation message.
  • Split payment. You pay a reservation to Zarpar today, and the balance directly to the operator at the departure dock on the day of the activity. Both amounts, and the dock, are stated before you pay. The reservation is part of the total price, not an additional charge.
  • Zarpar answers for the amount it collected. If the operator does not provide the activity, or provides it in a way substantially different from what was booked, Zarpar refunds you in full the reservation you paid to Zarpar and assists you with any claim relating to the balance paid at the dock. You will never be charged twice for the same place.
  • The operator answers for the operation. How the activity is run — equipment, staff, vessel, guiding and safety decisions — is the operator's responsibility, and their own rules and safety protocols apply on board. Nothing in this Section reduces the rights the law grants you in respect of the amount you paid to Zarpar.
  • Safety conditions. Diving and snorkelling are physical activities subject to health requirements. You must truthfully declare your medical conditions and, where the experience requires it, prove your certification level. For your safety, you must not dive after consuming alcohol, and after diving you must not fly for the period the operator indicates (generally 18 to 24 hours). The operator may deny boarding, without providing the activity, to anyone who does not meet these conditions or whose condition on the day puts their safety or the group's at risk; where that happens because of information you concealed, Section 4 applies to the amount paid.
  • Minors. Minimum age and adult supervision are set by the operator for each experience and are stated before payment.
  • By making payment you declare that you know and accept this condition.

If anything does not match what was booked, report it the same day via WhatsApp or to our contact email. That is when we can verify it with the operator and give you a solution.

4. Cancellation and Refund Policy

4.1 Customer Cancellations

  • More than 7 days before: 80% refund
  • 3-7 days before: 50% refund
  • Less than 3 days: No refund

4.2 Weather Cancellations

In case of severe weather conditions deemed unsafe by maritime authorities or the service provider, you may reschedule or receive a full refund.

4.3 Provider Cancellations

If a provider cancels your booking, you will receive a full refund or be offered an alternative service of equal or greater value.

5. User Responsibilities

  • Arrive on time at the designated meeting point
  • Bring valid identification documents
  • Follow all safety instructions provided by staff
  • Respect the Conduct Rules on Board and Islands (see separate document)
  • Declare any medical conditions that may affect your participation

6. Liability

6.1 Service Provider Responsibility

Service providers are responsible for the delivery of their services. Zarpar acts as an intermediary and is not liable for the actions or omissions of service providers.

6.2 Personal Belongings

You are responsible for your personal belongings. Neither Zarpar nor service providers are liable for lost, stolen, or damaged items.

6.3 Medical Conditions

Participation in maritime activities is at your own risk. Consult with your physician if you have any health concerns. We are not liable for any health-related incidents.

7. Age Requirements

Minors (under 18) must be accompanied by a responsible adult. Some activities may have specific age restrictions.

8. Intellectual Property

All content on Zarpar.com.co, including text, graphics, logos, and images, is the property of Zarpar or its content suppliers and is protected by copyright laws.

9. Privacy

Your use of our platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

10. Changes to Terms

We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting. Continued use of the platform constitutes acceptance of the modified terms.

11. Governing Law

These Terms and Conditions are governed by the laws of Colombia. Any disputes arising from these terms shall be resolved in the courts of Colombia.
